In a surprising turn of events that many in the educational community are discussing, a judge has recently thrown out the lawsuit filed by Jeffrey Hsi, a teacher at Valley Stream South High School. Hsi claimed that he was unjustly removed from his position in a science research program due to the undue influence of a school board trustee.
On Friday, State Supreme Court Justice Donald X. Clavin Jr., based in Nassau County, issued a four-page ruling in favor of the Valley Stream Central High School District. Justice Clavin emphasized that the New York State Education Department's commissioner, Betty A. Rosa, holds "primary jurisdiction" over such disputes, and pointed out that Hsi had not exhausted all administrative options before seeking legal recourse.
He stated, "Educational policy matters, which rely heavily on the professional judgment and discretion of those managing public schools, should not be resolved through the courts," referencing earlier judicial decisions that support this stance.
Hsi, who represented himself throughout this legal process, chose not to make any comments following the ruling, nor did district officials provide statements when approached for their input.
The controversy erupted after Hsi, a tenured physics educator with an impressive 22-year history leading the school's science research program, contended that he was unfairly removed from his role. The decision came after complaints from trustee Melissa Herrera and her husband, Jonathan Herrera, concerning their son’s disqualification from the New York State Science and Engineering Fair in March. Hsi had signed the student’s application, asserting he was a "qualified scientist" and a member of an Institutional Review Board for the project, which led to claims of a conflict of interest.
Hsi defended his actions by explaining that a technical glitch on the competition's website necessitated the submission of a qualified scientist form, despite it being irrelevant to the student's project. He argued he signed the form in a "last-minute, good-faith effort" to assist the student in meeting the submission deadline.
Following the disqualification, Hsi reported that the Herreras insisted on disciplinary action against him. After undergoing multiple investigations, he received a counseling memo in June instructing him to avoid similar conduct in the future. Remarkably, just one day after this memo was issued, Hsi learned he had been removed from the science research program, as detailed in his lawsuit.
This decision ignited significant backlash from former students, many of whom have voiced their admiration for Hsi as a dedicated mentor who inspired them to reach their full potential. They expressed concerns that his removal would deny future students access to his invaluable guidance and expertise.
In October, Hsi initiated legal proceedings aiming to regain his position in the research program. His lawsuit included documents featuring complaints from Jonathan Herrera, who asserted that his son’s disqualification was entirely due to Hsi's supposed disregard for established ethical standards.
As of now, the Herreras have not provided any comments regarding the unfolding situation.
